How to prepare for Bankurptcy
How do you know whether you should consider bankruptcy? Ask yourself these simple questions:
- Have you been juggling monthly credit card payments to make your mortgage?
- Have you received more than one collections call or letter in the past month?
- Have you skipped loan payments to meet a family financial need?
- Have you considered having to move or sell your house to avoid foreclosure?
- Have you discussed your debt problem with a credit counselor or loan modification company?
- Have you argued with your loved one about money and debt?
For most people, excessive debt isn’t something that happens overnight. It’s a typical pattern. One credit card payment gets out of hand, so you transfer balances. Suddenly, you add more debt or apply for another card. After all, the creditors want you to have as many as possible. Suddenly, you miss a payment and the fees and penalties start adding up and you discover that you really aren’t paying off any of the amount you owe. Next thing you know, you’re skipping a house or car payment to keep the collectors at bay. A year or two of juggling and you’re ready for a new start.

Some Things to Prepare for Before Filing
Your life will change a little after filing for bankruptcy, but most of the change will be positive. Nonetheless, there are some things that you will want to have in place.
Decide which debts you need to get rid of and which you are willing to reaffirm, such as the house and car.
- Try to get up to date on your house and car payments.
- Gather all statements relating to all of your debts, including the debts you plan to keep.
- Do not take on any additional debt, including a second mortgage or home refinance.
- Do not start the process of a purchasing a new car or house or signing a new apartment lease.
- Try to pay off any small amount of debt with short term balances.
- If you are in the process of a divorce, consider waiting until your debts have been discharged before negotiating a final settlement with your ex-spouse.
(Note, we will gladly work with your divorce attorney(s) to make your debt go away and pave the way for a better divorce.)
